CIRCULAR

PROMULGATING REGULATION ON PROFESSIONAL STANDARDS FOR
TEACHERS OF GENERAL EDUCATION INSTITUTIONS

Pursuant to the
Government’s Decree No. 69/2017/ND-CP May 25, 2017 defining the functions,
tasks, powers and organizational structure of the Ministry of Education and
Training;

Pursuant to the
Government’s Decree No. 75/2006/ND-CP dated August 02, 2006 detailing and
guiding the implementation of a number of articles of the Education Law; the
Government’s Decree No. 31/2011/ND-CP dated May 11, 2011 amending and
supplementing a number of articles of the Government’s Decree No. 75/2006/
ND-CP of August 2, 2006, detailing and guiding a number of articles of the
Education Law; the Government’s Decree No. 07/2013/ND-CP dated January 9, 2013
amending Point b, Clause 13, Article 1 of the Government’s Decree No.
31/2011/ND-CP of May 11, 2011 amending, supplementing a number of articles of
the Government’s Decree No. 75/2006/ND-CP dated August 2, 2006 detailing and
guiding the implementation of a number of articles of the Education Law;

At the request of the
Director General of Teachers and Educational Managers Department;

The Minister of
Education and Training promulgates a Circular on regulation on professional
standards for teachers of general education institutions.

Article 1. Promulgated together with this Circular is the Regulation
on professional standards for teachers of general education institutions

Article 2. This Circular comes into force as of October 10, 2018.

Article 3. Chief of Office, Director General of Teachers and Educational
Managers Department, Heads of relevant units under the Ministry of Education
and Training, Directors of Education and Training Departments, Heads of
relevant organizations and individuals shall be responsible for the

Article 1. Scope and
regulated entities

1. The Regulation on
professional standards for teachers of general education institutions includes
professional standards for teachers of general education institutions
(hereinafter referred to as “professional standards”) and guidance on use of
professional standards for teachers.

2. This Regulation
applies to teachers of primary schools, middle schools, high schools, combined
schools, selective schools, boarding schools for ethnic minority students and
day schools for ethnic minority students (hereinafter referred to as “general
education institutions”) and relevant organizations and individuals.

Article 2. Purposes of promulgation of the Regulation on professional
standards. The Regulation is the basic for:

1. Teachers of general
education institutions to carry out self-assessment of the qualities and
capacity; make and implement the plans for practice of qualities and refresher
training in improvement of capacity for professional skills in order to meet
the requirements for educational innovation.

2. General education
institutions to evaluate the qualities, capacity for professional skills of
teachers; make and develop the plans for refresher training in improvement of
capacity for professional skills of teachers in order to meet educational
objectives of schools, local authorities and education industry.

3. State management
authorities to research, make and implement the regimes and policies on
development of the contingent of teachers of general education institutions;
select and use the contingent of key teachers of general education
institutions.

4. Training and refresher
training establishments to develop programs and organize training and refresher
training in order to develop the qualities and capacity for professional skills
of teachers of general education institutions.

1. Quality means a
teacher’s ideology, morality or lifestyle in performance of works and duties.

2. Capacity means
a teacher’s ability to perform works and duties.

3. Professional
standard for teacher
means a system of quality and capacity that a teacher
must have in order to teach and educate students in general education
institutions.

4. Standard means
requirement for quality and capacity in each sector of professional standard
for teacher.

5. Criterion means
requirement for quality and capacity that are components of the standard.

6. Level of
qualification
means the level that a teacher has reached in development of
quality and capacity of each criterion. There are three levels in ascending
order: qualified, good, excellent. The higher level includes the requirements
of the adjacent lower level.

a) Qualified: The teacher
has the quality and capacity to perform assigned tasks in teaching and
education for students according to regulations;

b) Good: the teacher has
the quality and capacity for self-study, self-practice, innovation in
performance of assigned tasks;

c) Excellent: the teacher
has the positive influence on the students, colleagues, students’ parents or
guardians in formulation of the educational objectives of general education
institutions and the development of local education.

8. Assessment
according to professional standard for teacher
means determination of the
level of achievement in a teacher’s quality and capacity according to
regulations of professional standard for teacher.

9. A key teacher of a
general education institution
means a teacher who has good moral quality;
understands the educational situation; has great capacity for professional
skills; has prestige in the school; is capable of advising, consulting,
supporting, leading and sharing with colleagues in professional activities,
refresher training and development of professional capacity.

10. Digital learning material
means
documents, information data and resources that are digitized and
stored in order to serve teaching and learning.

Chapter II

PROFESSIONAL STANDARDS FOR TEACHERS

Article 4. Standard 1.
Quality

Comply with regulations
and practice teacher’s ethics; share experience, support colleagues in practice
of ethics and making of virtues

c) Excellent: The teacher
is a role model in terms of ethics, shares experience, support colleagues in
practice of ethics

2. Criterion 2. Virtue

a) Qualified: The teacher
has manner and method of working in conformity with works;

b) Good: The teacher has
awareness of self-training to create an exemplary virtue; great influence on
students;

c) Excellent: The teacher
is a role model in terms of virtues, has great influence and support colleagues
in making of virtues.

Article 5. Standard 2.
Development of professional skills

Acquire knowledge and
master skills; regularly update and improve capacity for professional skills in
order to meet requirements for educational innovation.

1. Criterion 3.
Development of personal knowledge

a) Qualified: The teacher
satisfies standards in training and complete all courses on training, refresher
training in professional knowledge according to regulations; has the plan for
regular study and refresher training in development of personal development;

c) Excellent: The teacher
guides, supports colleagues and shares experience in the development of
personal knowledge in order to meet requirements for educational innovation.

2. Criterion 4.
Development of the plans for teaching and education towards development of
qualities and capacity of students

a) Qualified: The teacher
makes the plans for teaching and education;

b) Good: The teacher
actively adjusts the plans for teaching and education in accordance with the
actual conditions of the school and the local area;

c) Excellent: The teacher
guides and supports colleagues in development of the plans for teaching and
education.

3. Criterion 5. Use of
methods of teaching and education towards development of qualities and capacity
of students

a) Qualified: The teacher
applies methods of teaching and education to development of qualities and
capacity of students;

b) Good: The teacher
actively updates, flexibly and effectively applies methods of teaching and
education in order to meet the requirements for innovation and actual
conditions;

c) Excellent: The teacher
guides and supports colleagues in knowledge, skills and experience in
application of methods of teaching and education towards development of
qualities and capacity of students.

uses methods of inspection and assessment of the learning outcomes and progress
of students;

b) Good: The teacher
actively updates and creatively applies forms, methods and tools of inspection
and assessment towards development of the qualities and capacity of students;

c) Excellent: The teacher
guides and supports colleagues in experience in effective implementation of the
inspection and assessment of the learning outcomes and progress of students.

5. Criterion 7.
Counseling and support for students

a) Qualified: The teacher
understands students and masters regulations on counsel and support for
students; integrates the counseling and support for students into teaching and
education

b) Good: The teacher
effectively implements appropriate measures for counselling and support for
each student in teaching and education;

c) Excellent: The teacher
guides and supports colleagues in experience in effective implementation of
counseling and support for students in teaching and education.

Article 6. Standard 3.
Development of educational environment

Develop an educational
environment that is safe, healthy and democratic; anti-bullying and
anti-violence

a) Qualified: The teacher
complies with the school’s rules and codes of conduct according to regulations;

b) Good: The teacher
proposes measures to effectively implement the school’s rules and codes of
conduct in accordance with regulations; has solutions for prompt and effective
handling of violations against the rules and codes of conduct in the classroom and
school within the scope of their charge (if any);

c) Excellent: The teacher
is a role model; shares experience in building of healthy culture environment
in school.

2. Criterion 9.
Democratic rights in school

a) Qualified: The teacher
complies with regulations on democratic rights in school, organizes students to
exercise democratic rights in schools; organizes students’ execution of
democracy rights in school;

b) Good: The teacher
proposes measures to promote democratic rights of students, teachers, students’
parents or guardians and colleagues in school; promptly detects, reflects,
prevents and handles violations against the student’s democratic regulations
(if any);

c) Excellent: The teacher
guides and assists colleagues in exercising and promoting democratic rights of
students, teachers, students’ parents or guardians and colleagues.

3. Criterion 10.
Development and maintenance of safety, anti-bullying and anti-violence in
school.

a) Qualified: The teacher
complies with regulations on safety, anti-bullying and anti-violence in school.

is an advanced example of development and maintenance of the safety,
anti-bullying and anti-violence in school, shares experience in development and
maintenance of the safety, anti-bullying and anti-violence in school

Article 7. Standard 4.
Development of family-school-community partnerships

Organize and implement
activities in order to develop the family-school-community partnerships
in teaching, moral education and lifestyle for students

1. Criterion 11.
Development of cooperation with students’ parents or guardians and relevant
parties

a) Qualified: The teacher
complies with applicable regulations applied to students’ parents and or
guardians and relevant parties;

b) Good: The teacher
develops healthy and close relationship with students’ parents and or guardians
and relevant parties;

c) Excellent: The teacher
recommends measures to the school for enhancement of close cooperation with
students’ parents or guardians and relevant parties.

2. Criterion 12.
Family-school-community partnerships in education for students

a) Qualified: The teacher
adequately and promptly provides information on the learning and practice of
students in class; information on programs, syllabuses and educational
activities for students’ parents or guardians of relevant parties; receives
information from the student’s parents or guardians and relevant parties about
the learning and practice of students;

c) Excellent: The teacher
promptly responds to feedback from students’ parents or guardians and relevant
parties about the process of learning, practice and implementation of the
programs, syllabuses and educational activities of the students.

3. Criterion 13.
Family-school-community partnerships in education about ethics and lifestyle for
students

a) Qualified: The teacher
organizes and provides information about the school’s rules and codes of
conduct for students’ parents or guardians and relevant parties; receives
information from the student’s parents or guardians and relevant parties about
the ethics and lifestyle of students;

b) Good: The teacher
actively cooperates with colleagues, students’ parents or guardians and
relevant parties in education about ethics and lifestyle of students;

c) Excellent: The teacher
promptly responds to feedback from students’ parents or guardians and relevant
parties about education about ethics and lifestyle of students.

Article 8. Standard 5.
Use of foreign languages ​​or ethnic languages, application of information
technology, operation and use of technological equipment for teaching and
education.

Use foreign languages
​​or ethnic languages, apply information technology, operate and use
technological equipment for teaching and education.

1. Criterion 14. Use of
foreign languages ​​or ethnic languages

a) Qualified: The teacher
can use simple words for communication of a foreign language (especially,
English) or a second foreign language (for foreign language teachers) or an
ethnic language for job positions that require the ethnic language.

c) Excellent: The teacher
can write simple paragraphs about familiar topics regarding educational
activities by a foreign language (especially, English) or a second foreign
language (for foreign language teachers) or an ethnic language for job
positions that require the ethnic language.

2. Criterion 15.
Application of information technology, operation and use of technological
equipment for teaching and education.

a) Qualified: The teacher
is able to use basic application software, technological equipment for
teaching, education and management of students according to regulations;
completes training and refresher training courses, operates and applies
information technology and technological equipment to teaching and education
according to regulations;

b) Good: The teacher
applies information technology and digital learning materials to teaching and
education; effectively updates and uses the software; operates and uses technological
equipment for teaching and education

c) Excellent: The teacher
guides and supports colleagues in improvement of capacity for application of
information technology; operates and uses technological equipment for teaching
and education;

Chapter III

GUIDANCE ON USE OF PROFESSIONAL STANDARDS
FOR TEACHERS

Article 9.
Requirements for assessment according to professional standards for teachers

1. Objective,
comprehensive, fair and democratic assessment.

3. Carry out assessment
according to the level of each criterion achieved in Chapter II of this
Regulation and have authentic and appropriate evidences.

Article 10. Process of
assessment and classification of results of assessment according to
professional standards for teachers

1. The process of assessment

a) The teachers shall
carry out self-assessment according to professional standards for teachers

b) The general education
institutions shall collect opinions from colleagues of teachers subject to
assessment according to the professional standards of teachers in the
professional group.

c) The heads of the
general education institutions shall access and notify the results of
assessment of teachers according to the results of self-assessment, opinions of
colleagues and actual performance of duties via authentic and appropriate
evidences.

2. Classification of the
results of assessment

a) Excellent: All
criteria shall reach good level or higher; in which, at least 2/3 of the
criteria shall reach the excellent level. In particular, the criteria in
Article 5 of this Regulation shall reach the excellent level;

b) Good: All criteria
shall reach qualified level or higher; in which, at least 2/3 of the criteria
shall reach the good level or higher. In particular, the criteria in Article 5
of this Regulation shall reach the good level or higher;

d) Unqualified: One of
the criteria is not satisfied because the requirements for that qualification
level are not fully satisfied.

Article 11. Frequency
of assessment according to professional standards for teachers

1. The teachers shall
carry out self-assessment once a year at the end of the school year.

2. The heads of general
education institutions shall assess teachers every two years at the end of the
school year.

3. In special cases, with
the consent of the superior management agency, the school can shorten the
frequency of assessment.

Article 12. Key
teachers of general education institutions

1. Standards of selection
for key teachers of general education institutions

a) Be a teacher at a
general education institution with at least 5 years experience in direct
teaching at the education same level up to the time of selection;

b) Be assessed at good
level or higher according to professional standards for teachers, in which the
criteria in Article 5 of this Regulation must reach the excellent level;

d) Be capable of using
foreign languages, applying information technology, operating and using
technological equipment for teaching and education, developing digital learning
materials, carrying out refresher training for teachers;

e) Have aspiration to
become a key teacher of a general education institution.

In case the number of
teachers who satisfy the conditions specified at Points a, b, c, d, e, Clause 1
of this Article is greater than the number imposed by the superior management
agency, prioritize the selection of key teachers according to the following
standards: having qualifications above the training standards; being assessed
at good level according to the professional standards for teachers; being
recognized as excellent teachers at the provincial level or having excellent
achievements in teaching and education; having scientific and technical
research products, innovative solutions in teaching and education that are
recognized and widely used in school and in province.

2. The process of
selection for key teachers of general education institutions

a) The general education
institution shall select, propose the key teachers and reports to the superior
management agency;

b) The head of the
Education and Training Division shall select and approve key teachers according
to his/her competence; report to the Department of Education and Training;

c) The Director of
Department of Education and Training shall select and approve the list of key
teachers according to his/her competence; report to the Ministry of Education
and Training upon request.

3. Duties of key teachers
of general education institutions

a) Support and advise
colleagues in the school or other schools in province to develop the quality,
capacity for professional skills according to professional standards for
teachers in conformity with actual conditions of the school and other schools
in province.

c) Guide and support
colleagues in the school or other schools in the province in development and
implementation of the plans for education and teaching; implementation of
training and refresher training courses for teachers via the Internet;
refresher training and training in order improve capacity for professional
skills for teachers in the school or other schools in the province. Participate
in annual training and refresher training according to the requirements of the
sector (Division, Department and Ministry);

d) Advise and consult
direct management agency about the development of plans for education in
conformity with specific conditions of the province in order to ensure the
objectives, quality of teaching, education and improve capacity for
professional skills of the teachers; participate in organization and report on
professional skills at seminars, professional activities of the school or other
schools in province;

e) Cooperation with
establishments that carry out training and refresher training for teachers;
institutions that research, apply and transfer educational science (especially
applied pedagogical science).

Chapter IV

IMPLEMENTATION

Article 13.
Responsibilities of the Ministry of Education and Training

The Teachers and
Educational Managers Department shall direct, guide and inspect the
implementation of the regulations of this document; develop the plans for
training, refresher training and development of the contingent of teachers at
general education institutions in order to meet the requirements of the
qualities and capacity according to professional standards for teachers.

Article 14.
Responsibilities of Departments of Education and Training

1. Direct and organize the implementation of this Regulation
under their competence; update and report to the Ministry of Education and
Training on the results of assessment of teachers according to professional
standards for teachers before June 30 every year.

Article 15.
Responsibilities of Education and Training Divisions

1. Direct and organize
the implementation of this Regulation according to their competence; update and
report to the Departments of Education and Training on the results of
assessment of teachers according to professional standards for teachers before
June 30 every year.

2. Make and implement the
plans for training, refresher training and development of the contingent of
teachers at general education institutions under their competence according to
the results of assessment of teachers under professional standards for
teachers.

Article 16.
Responsibilities of general education institutions

1. The heads of the
general education institutions shall direct and organize the assessment of
teachers according to professional standards for teachers; update and report to
the superior management agencies on the results of assessment of teachers
according to professional standards for teachers.

2. Make and implement the
plans for training, refresher training and development of the contingent of
teachers at general education institutions under their competence according to
the results of assessment of teachers under professional standards for
teachers.

3. Advise the superior
management agencies and local authorities on the management, refresher training
in order to improve the qualities, capacity for professional skills for
teachers of general education institutions according to the results of the
assessment according to professional standards for teachers.
